Heard learned counsel for the petitioner no.2 and the State.

The petitioner no. 2 apprehends arrest in a case registered for the offence punishable under sections 379/34 and other ancillary sections of the Indian Penal Code and section 27 of the Arms Act.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Though there is allegation of resorting to fire, but nobody sustained fire arms injuries. There is long standing land dispute

Patna High Court CR. MISC. No.35596 of 2022(2) dt.01-11-2022 2/2 between the parties. There is case and counter case and petitioner's case is earlier in point of time. Considering the aforesaid facts of the case, prayer for bail of the petitioner no. 2 is allowed. In the event of arrest/surrender within six weeks from today, let the petitioner no. 2 mentioned above be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate IV, Sahrsa in Salkhua Police Station (Bnma Itahari OP) case no. 68 of 2022, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
