JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 28-04-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners seek bail in a case registered for the offences punishable under Sections 304B, 201/34 of the Indian Penal Code.

Petitioners happen to be parents in law of the deceased and according to prosecution case itself, the deceased was taken to the house of informant on 20.09.2015 in critical condition and after that informant along with husband of the deceased proceeded to hospital but on way, it was decided to take the deceased before an Ojha and after that in laws of the deceased took her from there and subsequently, they disposed of their dead

Contention on behalf of the petitioners is that deceased died due to snake bite and as a matter of fact, after five days of death of the deceased, the informant brought this false case and moreover, when she realized her fault, she entered into compromise.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioners be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Kaimur at Bhabua in connection with Ramgarh (Nuaon) P.S. Case No. 250 of 2015.
