JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 27-05-2019 Heard learned counsel for the petitioner and learned learned Additional Public Prosecutor for the State. The petitioner is in custody in connection with Buxar Town P.S. Case No. 251 of 2019, POCSO Case No. 13/2019 for the offenses under Sections 500, 504, 506, 507, 508, 509, 420, 467, 468, 471, 354(B) of the Indian Penal Code and Sections 12,13, 14, 16 of the POCSO Act, 2012 and Sections 67, 67A and 67B of the Information Technology Act.
Learned counsel for the petitioner submits that the petitioner has clean antecedent. He is in custody since 20.3.2019.
Mr. Sunil Kumar Singh, learned counsel for the
Patna High Court CR. MISC. No.33834 of 2019(2) dt.27-05-2019 2/2 informant submits that during the investigation it transpired that the petitioner was involved in sending filthy message to the minor girl and that the trial has commenced. He admits that the case has been registered against unknown.
Considering the fact that the petitioner has no criminal antecedent, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the 1st Additional Sessions Judge cum Special Judge, Buxar in connection with Buxar Town P.S. Case No. 251 of 2019, POCSO Case No. 13/2019.
