JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 20-05-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. This application, for grant of anticipatory bail, arises out of Angarghat P.S. Case No.72 of 2015, disclosing offences under Sections 452, 323 and 376/511 of the Indian Penal Code and Section 3(1) (x) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act.
Since an offence, under Section 3(1) (x) of the Scheduled Castes and Scheduled Tribes (Prevention of
Patna High Court Cr.Misc. No.20346 of 2016 (2) dt.20-05-2016 2/2 Atrocities) Act, is made out, this anticipatory bail application cannot be maintained in view of Section 18 of the said Act.
This application is, accordingly, rejected.
The petitioner, abovenamed, is directed to surrender before the court below within a period of four weeks from today and seek regular bail, if so advised. If he does so, his application for regular bail shall be considered by the learned court below on its own merit without being prejudiced by rejection of present application for grant anticipatory bail.
