JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 17-07-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner happens to be husband of the deceased and according to the prosecution case, deceased was assaulted and administered poison and the informant claimed in his written report that he had seen mark of injuries on the person of the deceased when he had reached at Sadar Hospital, Motihari. The post mortem report reveals that no visible injury was found on the body of the deceased. Moreover, it is obvious from the first information report itself that deceased was taken to hospital by her in-laws.
Considering the aforesaid facts and circumstances as
Patna High Court Cr.Misc. No.23369 of 2015 (2) dt.17-07-2015 2/2 well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, East Champaran at Motihari in connection with Piprakothi P.S.Case No. 74 of 2014.
