The petitioner seeks bail in a case registered under Sections 341, 323, 324, 325, 307, 379, 504, 506/34 of the Indian Penal Code.

The prosecution case in short is that while the informant was engaged in carrying gallon of oil from his house, the accused persons variously armed came there and started abusing. On protest, the accused persons assaulted the informant, as a result of which, he sustained bleeding injury. It has been submitted on behalf of the petitioner that there is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 03-04-2019. The nature of injury is said to be simple. No offence u/S 307 of the

Patna High Court CR. MISC. No.32646 of 2019(2) dt.17-05-2019 2/2 Indian Penal Code is made out. Rest of the offences are triable by the Magistrate.

On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-III, Madhepura in connection with Srinagar P.S. Case No. 85 of 2018.
