The matter has been taken up through video conferencing.
The petitioner seeks bail in Turkauliya P.S. case No. 14/2020 registered u/s 401, 413, 414 of the IPC. The informant on secret information intercepted a vehicle on which three persons were sitting and apprehended all the three persons, namely, Neyaz Alam @ Tigar, Mansoor Alam and Tapesh Majhi, the petitioner. From the possession of Mansoor Alam one dagger was recovered. Nothing has been recovered from the possession of the petitioner. The learned counsel for the petitioner submits that petitioner is in custody since 08.01.2020. Neyaz Alam @ Tigar has already been granted bail vide order passed in Cr. Misc. No.
Patna High Court CR. MISC. No.32380 of 2020(2) dt.07-12-2020 2/2 31272/ 2020. Mansoor Alam has also been granted bail and the case of petitioner stands on better footing as nothing has been recovered from the possession of the petitioner and the petitioner was simply a pillion rider.
Considering the facts aforesaid and the nature of allegation made against the petitioner and the fact that petitioner has remained in jail fore more than 10 months, the petitioner, above named, is directed to be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, East Champaran, Motihari in connection with Turkauliya P.S. case No. 14/2020.
