Petitioner happens to be co-villager of the informant and admittedly, he is not named in the first information report but in course of investigation, the informant and some witnesses claimed to have identified the petitioner at the time of alleged occurrence. Moreover, the petitioner does not have any criminal antecedent, and having more or less similar allegation, one co-accused, namely Chichai Yadav and some others have already been granted privilege of bail.
