The petitioners apprehend their arrest in connection with Muffasil P.S. Case No.30 of 2021 registered for the offence under Sections 147, 148, 149, 448, 323, 325, 354(B), 354(C), 506, 504 of the IPC and 8 of the POCSO Act.
It is a case of assault and outraging of modesty of the informant's daughter by the petitioners.
Learned counsel appearing on behalf of the petitioners submit that petitioners are innocent and have falsely been implicated
Patna High Court CR. MISC. No.44516 of 2021(2) dt.23-03-2022 2/2 in the present case. He further submits that there is case and counter case between the parties and informant and petitioners are agnates. Learned counsel appearing on behalf of the petitioners submit that both the parties are agnates, compromise has been done between them without any pressure, and in support of that Annexure-3 has been annexed to this petition. Petitioners have clean antecedent. Learned APP appearing for the State has opposed the prayer for anticipatory bail.
Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from today, is directed to be released on anticipatory bail on furnishing bail bonds of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J.,VIth-cum-Exclusive Special Judge (POCSO Act), Munger in connection with Muffasil P.S. Case No.30 of 2021, subject to the conditions as laid down under section 438(2) of the Cr.P.C.
