JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-08-2019 This application, for grant of anticipatory bail, arises out of Jhajha P.S. Case No. 198 of 2018, disclosing offences under Sections 376/341, 323 and 34 of the Indian Penal Code. Allegation against the petitioner and two others is that they dragged the informant out of her house and this petitioner alleged to have committed rape on her.

Submission of learned counsel for the petitioner is that entire allegation is false and concocted and no such occurrence has ever taken place and further there is delay of four days in lodging the F.I.R.

Heard learned A.P.P. as well as learned counsel for the informant. Learned counsel for the informant has submitted

Patna High Court CR. MISC. No.34660 of 2019(3) dt.21-08-2019 2/2 that no such information as mentioned in the F.I.R. has been given by her to the police.

Having heard both sides, in view of the above facts, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Jamui, in connection with Jhajha P.S.
