Petitioner is accused in connection with S. Tr. No. 592 of 2014 arising out of Matihani P.S. Case No. 89 of 2014 registered under Section 302/34 of the I.P.C. and under Section 27 of the Arms Act.
Learned counsel appearing on behalf of the petitioner submits that it would appear from the F.I.R. that while the son of the informant was talking to anyone on mobile, two unknown persons came on the Bolero, one of them armed with pistol shot at the deceased, son of the informant, who died on the spot. It is further submitted that informant did not disclose the name of anyone in the F.I.R. Later on, in course of investigation, in paragraph no.14, Bebi Devi has stated that at the time of occurrence, this petitioner was present in the Bolero vehicle and
Patna High Court Cr.Misc. No.23286 of 2015 (3) dt.12-08-2015 2/2 Gudu Singh, in paragraph no.19, also stated that this petitioner was seen in the Bolero vehicle and the deceased was shot fired by one Prince Kumar. It is also submitted that, in fact, petitioner has been made accused in four other cases, due to that reasons, the Police has falsely implicated this petitioner in the present case. It is further submitted that petitioner is in custody since 10.07.2014. Having considered the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of 6th Addl. Sessions Judge, Begusarai in connection with S. Tr. No. 592 of 2014 arising out of Matihani P.S. Case No. 89 of 2014. Out of two sureties, one surety must be parent or close relatives of the petitioner.
