Petitioner is languishing in custody since 14.12.2015 in a case registered for the offences punishable under Sections 399, 402, 414, 412 of the Indian Penal Code, 25(1-B)a, 26, 35 of the Arms Act and 18, 22, 24, 25 of the Narcotics Drugs and Psychotropic Substances Act. The prosecution case is that on secret information that miscreants are preparing to commit dacoity, a raid was led, two accused persons were apprehended and from their possession one country made pistol, .315 bore cartridge and 70 sachets of ganja were recovered.

It is submitted by the learned counsel for the petitioner that recovery of ganja is small quantity. The

Patna High Court Cr.Misc. No.16437 of 2016 (3) dt.21-04-2016 investigation has already concluded. Though the petitioner was made accused in two other cases, but in both cases he is on bail.

Considering the fact that recovery of ganja is small quantity, let the above named petitioner, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J.-2, Patna in connection with Special Case No. 48 of 2015, arising out of Chowk P.S. Case No. 284 of 2015. The learned court below will be at liberty to cancel the bail bonds of the petitioner, if he substantially gets involved in some serious nature of the offence or if he defaults for two consecutive occasions.
