The petitioner has preferred this application for grant of regular bail in a case registered under sections 30(a) and 30(d) of the Bihar Prohibition and Excise Act, 2016. As per the prosecution case, on a raid being conducted it is stated that 10 litres of country liquor, 15 quintals of brown sugar (mitha) besides other articles are stated to have been recovered from the godown.

It is submitted by learned counsel for the petitioner that the petitioner is innocent and no incriminating article has been recovered from his shop or godown. He has been falsely implicated in the case at the instance of the local chaukidar. He is in custody since 27.6.2021 and has no criminal antecedent.

Having heard learned counsel for the parties and taking into consideration the facts of the case, the petitioner having remained in custody for over 7 months and not having any criminal antecedent, the petitioner is directed to be enlarged on bail in connection with Sahebganj P.S. Case no. 269 of 2021 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Muzaffarpur.
