====================================================== CORAM: HONOURABLE MR. JUSTICE ARVIND SRIVASTAVA ORAL ORDER 09-12-2020 Heard learned counsel for the petitioner and the learned A.P.P. for the State as well as Mr. Ashar Mustafa, learned counsel appearing for the informant.

The petitioner seeks bail in connection with Bathnaha P.S. Case No. 181 of 2019 for the offence under Sections 302/34 of the Indian Penal Code.

Learned counsel appearing for the petitioner submits that earlier the prayer for bail of this petitioner had been rejected by this Court vide order dated 05.03.2020 passed in Cr. Misc. No. 76802 of 2019. Now the prayer for bail of this petitioner has been renewed on the ground of custody only as the petitioner is languishing in judicial custody since 23.08.2019 i.e. more than one year and the

Patna High Court CR. MISC. No.32546 of 2020(2) dt.09-12-2020 2/2 likelihood of conclusion of trial is not expected in near future. Therefore, petitioner may be enlarged on bail. Mr. Ashar Mustafa, learned counsel appearing for the informant has vehemently opposed the prayer for bail of this petitioner.

Considering the facts and circumstances of the case, let the, above named, petitioner be released on bail on furnishing his personal bond to the satisfaction of C.J.M., Sitamarhi in connection with S.T. No. 458 of 2019 arising out of Bathnaha P.S. Case No. 181 of 2019.
