The petitioner seeks bail in connection with Silao P.S. Case No.20 of 2015 for the offence punishable under Section 379 of the Indian Penal Code and Section 136 of the Indian Electricity Act.
The prosecution story, in brief, is that on 30.01.2015 at about 11.30 P.M. in the night, some unknown thieves committed theft in 33/11 KVA Power Sub-Centre, Silao in which 2000 litres of transformer oil, one mobile and other electric equipments have been stolen away causing a loss of Rs.3,50,000/- to the South Bihar Power Distribution Company.

No.25387 of 2015 (2) dt.11-06-2015 2/2 It has been submitted on behalf of the petitioner that the petitioner is not named in the first information report and he has been falsely implicated in the present case due to mistake of fact. On behalf of the petitioner it has been contended that the petitioner is ready to deposit a sum of Rs.10,000/- in the court below, which may be subject to the final decision of the case. On behalf of the State, it has been submitted that during course of investigation, the name of the petitioner has figured as an accused in the present case.
Considering the facts and circumstances of the case, petitioner is directed to deposit a sum of Rs.10,000/- in the court below, which shall be subject to final disposal of the case, and on deposit of the said amount, he (Anil Kumar) shall be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Smt. Reshma Verma, Judicial Magistrate, Ist Class, Biharsharif, Nalanda in connection with Silao P.S. Case no. 20 of 2015. (Sudhir Singh, J) B.T/- U T
