JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 26-04-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner and several other accused are named in the first information report on the accusation that they made indiscriminate firing on the deceased.

Submission on behalf of the petitioner is that in course of investigation, it came to light that it was co-accused Tribhuwan Tiwary, who shot fire on the deceased and, moreover, only two firearm injuries were found on the person of the deceased. Having more or less similar allegation, some co-accused have already been granted privilege of bail.

Considering the aforesaid facts and circumstances as well as submissions of the parties and also taking note of this fact

Patna High Court Cr.Misc. No.16469 of 2016 (2) dt.26-04-2016 2/2 that petitioner does not have any criminal antecedent and the investigation against the petitioner has already been completed, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Siwan in connection with Mairwa P.S.Case No. 65 of 2015.
