The petitioner is accused in connection with Sessions Trial No. 43 of 2016/ 30 of 2016 corresponding to Roh P.S. Case No. 63 of 2015 registered under Section 304(B)/34 of the Indian Penal Code.

The accusation is of killing of sister of informant by her husband and in-laws due to non-fulfillment of demand of dowry.

Learned counsel for the petitioner submits that petitioner is the husband of the deceased and out of wedlock there are three children. But due to petty dispute in family she committed suicide by hanging herself, regarding which,

No.17820 of 2016 (2) dt.02-05-2016 information was given to the informant and police was also informed, which would appear from the F.I.R. as the informant has stated about seeing the dead body of his sister at the police station but due to ulterior motive petitioner has falsely been implicated in this case. Further submission is that petitioner is in custody since 08.09.2015.

Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Ist Additional Sessions Judge, Nawada, in connection with Sessions Trial No. 43 of 2016/ 30 of 2016.
