JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-09-2019 Petitioner seeks bail in anticipation of his arrest in connection with Danapur P.S. Case No. 244 of 2019 registered for the offences punishable under Sections 498A, 323 and 379 of the Indian Penal Code.

Allegation against the petitioner is that marriage of the informant was solemnized with the petitioner and at that time petitioner was showing himself employed in the City Bank but later on it appears that he was not employed in the City Bank and allegation against him is that he started demanding Rs.10 lac from the informant and for that she was mentally and physically tortured and ousted from the house.

Patna High Court CR. MISC. No.32619 of 2019(4) dt.20-09-2019 2/3 It further appears that on appearance of opposite party No.2 the matter was referred to the Patna High Court Mediation and Conciliation Centre as per report of Mediator at Flag 'M' mediation failed.

Submission of learned counsel for the petitioner is that opposite party No.2 is not ready to reside with the petitioner, rather she is ready for one time settlement and her demand was Rs.15 lac and as per instruction of opposite party No.2 petitioner has been terminated from service. Heard learned APP and perused the complaint petition, from which it appears that petitioner has married with opposite party No.2 by playing fraud that he was employed in the City Bank and thereafter allegation of demand and torture have been leveled against the petitioner and for that opposite party No.2 is not ready to reside with the petitioner. In view of above facts and circumstances, let petitioner, in the event of arrest or surrender, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the A.C.J.M.-I, Danapur, Patna, in connection with Danapur P.S. Case No. 244 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and
