2. In this case, the petitioner is seeking regular bail in connection with Areraj P.S. Case No. 13 of 2024, registered for the offences punishable under Sections 399/402 of the IPC and 25(1-b)a/26/35 of the Arms Act.

3. As per allegation, on a secret information, the informant along with other police party reached the place of occurrence. Seeing the police party, the accused persons including this petitioner started fleeing away. The petitioner became successful in fleeing away but co-accused Manu Malik was apprehended from whose possession, one katta and live cartridges were recovered.

4. The learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. Petitioner was not arrested at the spot. Nothing was recovered from his possession. His name has figured in confessional statement of apprehended co-accused. The petitioner is under custody since 15.03.2024.

5. Considering the above-mentioned facts and circumstances as well as the period of custody, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Areraj, East Champaran in connection with Areraj P.S. Case No. 13 of 2024, subject to the following condition:- (i) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
