The petitioner is an accused in connection with Buxar Rail P.S. Case No. 29 of 2015 registered under Section 392 of the Indian Penal Code.

The prosecution story, in brief, is that on 21.08.2015 at 21.15, the informant proceeded to Udhna Junction to Varanasi by Bholinagri Train No. 19057, Coach No. S-4, Birth No. 6, whereby Kurla Patna Express proceeded from Mangalsai to Buxar and reached Buxar at 6.52 and in his back bag Rs. 32 thousand and three persons standing near southern corner of Malgodown and out of whom one person took out pistol and taken him toward office of Malgodown and asked where is money and taken Rs. 32,000/- from bag and mobile and fled

It is submitted on behalf of the petitioner and the petitioner is in custody since 12.02.2016. Charge-sheet has been submitted in this case. He has falsely been implicated in the present case. The name of the petitioner has come on the basis of confessional statement of co-accused. The petitioner has not been put on T.I.P. nor there is any recovery of incriminating article. The other co-accused, namely, Mema Yadav and Sanjay Dom, have been granted bail vide Criminal Miscellaneous No. 55589 of 2015 on 05.02.2016.

On behalf of the State it is submitted that the petitioner is not named in the F.I.R.

Having considered the facts and circumstances of the case, let, above named petitioner, be released on bail on furnishing bail bond of Rs. 10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of learned Railway Judicial Magistrate, Bhojpur, Ara in connection with Buxar Rail P.S. Case No. 29 of 2015.
