2. The petitioner apprehends his arrest in connection with Sultanganj P.S. Case No.56 of 2024 instituted under Section 392 of the I.P.C. and Sections 25(1-b)a, 26 of the Arms Act.
3. As per prosecution case, three miscreants are alleged to have looted four mobiles, Rs.7700/-, A.T.M. Cards, Aadhar Card, PAN Card etc. on the point of country made pistol and fled away leaving their motorcycle. It is further alleged that in the evening of the alleged date of occurrence, one of the coaccused, namely, Sachin Kumar came there and asked about the
Patna High Court CR. MISC. No.38187 of 2024(2) dt.26-06-2024 2/3 left motorcycle upon which he was apprehended and disclosed the names of petitioner and other co-accused and on search, one mobile, one live cartridge and Rs.1500/-were recovered from his possession.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case as he is next door neighbour of apprehended accused Sachin Kumar with whom the petitioner is on inimical term. The petitioner is a young boy of 19 years. Except confessional statement, there is no material against the petitioner. The petitioner has no criminal antecedent and he undertakes to cooperate in the investigation and the trial.
5. Learned A.P.P. for the State opposes the prayer for anticipatory bail.

Considering the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M. I, Bhagalpur in connection with Sultanganj P.S. Case No.56 of 2024 corresponding to G.R. No.732 of 2024 subject to the conditions
