2. Petitioners apprehend their arrest in a case registered for the offence punishable under sections 304 (B), 201, 34 of the Indian Penal Code.

3. It is a case of dowry death.

4. Petitioners are brother-in-law of the deceased.

5. It is submitted that the petitioners are innocent and have falsely been implicated in this case. It is further submitted that the petitioners are separate in mess and business. Thrust of allegation is against the husband of the deceased who has already been granted regular bail by this Hon'ble Court vide

Patna High Court CR. MISC. No. 35175 of 2023(2) dt.21-07-2023 2/2 order dated 09.01.2020 in Cr. Misc. No. 52365 of 2019. Petitioners claim clean antecedent.

6. Learned counsel for the State opposed the bail petition.

7. Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioners, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the Learned Additional Chief Judicial Magistrate-XI, Bhagalpur in connection with Pirpainti P.S. Case No 246 of 2017, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
