Petitioner seeks bail in a case registered under section 379, 411/34 of the Indian Penal Code.

The stolen motorcycle is said to have been recovered from joint house of the petitioner and co- accused Jiwachha Rai but submission on behalf of the petitioner is that petitioner is in jail custody since 6.12.2015 and learned Sessions Judge has granted liberty to the petitioner to renew his prayer for bail before the court below after six months, if there is no substantial progress in the trial of the petitioner.

Petitioner does not have any criminal antecedent and admittedly, he has remained in jail custody for more than six months. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on
