Learned counsel for the petitioner is directed to remove the defect(s), as pointed out by the office, within a period of four weeks.
This modification application has been filed with a prayer to modify the order dated 06-05-2022 passed in Cr. Misc. No. 21674 of 2022 by which the petitioner has been allowed anticipatory bail in connection with Ujiyarpur P.S. Case No. 95 of 2022 pending in the court of learned Special Judge, Excise Court-I, Samastipur.
It has been submitted on behalf of the petitioner that in the main petition of Cr. Misc. No. 21674 of 2022, the name
Patna High Court CR. MISC. No.36316 of 2022(2) dt.27-07-2022 2/2 of father of the petitioner has wrongly been mentioned as "Ram Babu Mahto" in place of "Ram Babu Sah" and due to that, same mistake occurred in the cause title of the order 0605-2022 passed in Cr. Misc. No. 21674 of 2022. Hence, he seeks modification in the name of father of the petitioner. He also seeks further time to surrender in the court below. Accordingly, the order dated 06-05-2022 passed in Cr. Misc. No. 21674 of 2022 is modified to the extent that in the cause title of the order, the name of father of the petitioner be read as "Ram Babu Sah" in place of "Ram Babu Mahto" and time for surrender of the petitioner is extended for further six weeks from the date of receipt/production of the order. Rest of the conditions shall remain the same as mentioned in the order dated 06-05-2022 passed in Cr. Misc. No. 21674 of 2022.
