The petitioner seeks bail in a case registered for the offence punishable under Section 366(A) of the Indian Penal Code.

The informant alleged that his daughter was kidnapped and during course of search the informant came to know that the petitioner kidnapped his minor daughter. The victim made statement under Section 164 of the Cr.P.C. and she disclosed that one person kidnapped her at the point of pistol and took her somewhere else. The victim did not disclose the name of any person including the petitioner even in statement recorded under Section 164 of the Cr.P.C.

Considering the facts aforesaid, the petitioner above

Patna High Court Cr.Misc. No.23655 of 2015 (2) dt.09-07-2015 2/2 named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhagalpur in Sultanganj P.S.
