The petitioner is accused in connection with Jamo Bazar P.S. Case No. 6 of 2015 registered under Section 302 of the Indian Penal Code.

The allegation of informant, Bindu Devi, is that when her brother-in-law, Rabindra Singh, was sleeping at Dalan then petitioner, who is mentally ill, came and gave knife blow to Rabindra Singh, who died at the spot.

Learned counsel for the petitioner submits that it would appear from the F.I.R. that petitioner, who is the cousin of the deceased, is mentally ill and in course of investigation, police also verified the treatment paper of the petitioner as detailed in

Patna High Court Cr.Misc. No.24624 of 2015 (3) dt.05-10-2015 paragraph 23 of the case diary, in which, Dr. Alok Ranjan, has also stated about the treatment of the petitioner. It is further submitted that petitioner has no criminal antecedent and is in custody since 08.04.2015.

Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Siwan, in connection with Jamo Bazar P.S. Case No. 06 of 2015. Out of two sureties, one surety must be the close relative of the petitioner, who will file an affidavit showing his relation with the petitioner.
