The petitioner apprehends his arrest in connection with Jamhore P.S. Case No. 39 of 2019 registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2018.

Learned counsel appearing on behalf of the petitioner has submitted that there is no recovery from the conscious possession of the petitioner, but in paragraph-3 of the bail petition, the petitioner has been made accused in two cases bearing Obra P.S. Case No. 233 of 2018 for the offences punishable under Sections 147, 148, 307, 353, 332, 427, 504 of the Indian Penal Code and Aurangabad Muffasil P.S. Case No. 181 of 2017 for the offence punishable under Section 30(a) of

Patna High Court CR. MISC. No.33102 of 2019(3) dt.23-08-2019 2/2 the Bihar Prohibition and Excise Act, 2016.

In the facts and circumstances of the case, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the prayer for anticipatory bail is hereby rejected. However, the court below is directed to consider and dispose of the case on the same date.
