====================================================== CORAM: HONOURABLE MR. JUSTICE ASHOK KUMAR PANDEY ORAL ORDER 20-05-2026 Heard learned counsel for the petitioner and learned APP for the State through video conferencing.

2. The petitioner has prayed for bail in connection with S.Tr. No. 1234/2023 arising out of Motihari Muffasil P.S. Case No. 400 of 2023 registered for the offence punishable under Sections 302, 201, 120-B, 34 of the I.P.C.

3. The case of the prosecution, in short, is that some unknown miscreants have killed the husband of the informant.

4. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely implicated in this case. He further submits that during course of investigation, the name of this petitioner has surfaced on the basis of confessional statement of co-accused Anita Devi. It is stated in the confessional statement that the dead body was concealed in the bushes after killing. Learned counsel for the petitioner has submitted that nothing has been recovered pursuant to the confessional statement of this petitioner. Petitioner is in custody since 17.06.2023, having no criminal antecedent. It is apparent from the order of learned Trial Court that till today only one witness has been examined by the prosecution.

5. The application for bail is opposed by learned APP for the State.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the court of learned Additional Sessions Judge-X, East Champaran, Motihari in connection with S.Tr. No. 1234/2023 arising out of Motihari Muffasil P.S. Case No. 400 of 2023.
