The petitioner is in custody in a case registered under Sections 302, 201 and 506/34 of the Indian Penal Code. The informant has alleged that his daughter Kiran Kumari, aged 16 years, is a student of Ajmeripur School. On 16.3.2015 from his Bothan she had gone with Chandan Kuma Kanhaiya Kumar and Jiyalal Mandal on their call and since then he was searching his daughter and in the evening when he asked Jiyalal Mandal for her whereabout then he gave threats to kill if the matter is brought to the police. Today, on 19.03.2015 at 2 P.M. he got information that dead body of Kiran Kumari has been found in the maize field of Upi Yadav at Milki Bahair. He with

Patna High Court Cr.Misc. No.23992 of 2015 (2) dt.06-07-2015 2/2 his brothers went there and saw the dead body from which foul smell was coming and it appeared that she was killed earlier and her dead body was thrown here.

It has been submitted on behalf of the petitioner that there is no direct evidence against the petitioner. No specific allegation has been made against the petitioner. It is further submitted that at best it is a case of last seen. The petitioner is in custody since 21.04.2015. It is further submitted that the petitioner has no criminal antecedent.

On behalf of the State, is submitted that the petitioner is named in the FIR.

Considering the facts aforesaid, let above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Bhagalpur in Nathnagar P.S.Case No. 49/2015.
