JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 31-08-2021 Heard learned counsel for the petitioner and the learned A.P.P. for the State through Video Conferencing. The petitioner apprehends his arrest in connection with Complaint Case No. 350 of 2018, registered under Section 498-A of the Indian Penal Code and Section 4 of the Dowry Prohibition Act. The accusation is that marriage of complainant-opposite party no. 2, Babli Devi was performed with the petitioner on 03.05.2015 and due to their wedlock complainant-opposite party no. 2 was blessed with a issue but thereafter, she was being tortured for non-fulfillment of demand of dowry. Thereafter, she came to her Maika, where she was assaulted by her husband. Learned counsel for the petitioner submits that petitioner is the husband of the complainant-opposite party no.2 and he is still

He, further, submits that the registered notice, as issued to the complainant-opposite party no. 2, has been received by her mother but the complainant-opposite party no. 2 did not take any pain to appear before this Court, regarding which, a supplementary affidavit showing the jointness of opposite party no.2 with her mother has already been filed by the petitioner. Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Patna City, Patna, in connection with Complaint Case No. 350 of 2018, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
