JUSTICE SUDHIR SINGH ORAL ORDER 21-07-2015 Heard learned counsel for the petitioner and learned A.P.P. appearing for the State The petitioner is in custody in a case registered under Sections 302/34 of the Indian Penal Code. The prosecution case, in brief, is that on 20.02.2015 at about 9.00 P.M. on hearing the sound of firing from a nearby Government wine shop he found his son Rajesh Jaiswal, the salesman of the shop, lying on the ground in a pool of blood and he saw three unknown persons running away. Out of the three one was caught by the villagers. While the informant was taking his son to Varanasi for treatment, his son said that Angad Yadav, along with his three friends including the petitioner shot at him. The son of the informant, died on the way to Varanasai.

Patna High Court Cr.Misc. No.25056 of 2015 (2) dt.21-07-2015 It is submitted on behalf of the petitioner that the petitioner is in custody since 23.03.2015 and the charge sheet has been submitted in this case. It is further submitted that there is no direct evidence against the petitioner causing injury upon the deceased.

On behalf of the State it has been submitted that the petitioner's name has come in course of investigation. Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Kaimur at Bhabhua, in connection with Chainpur P.S.
