Heard the learned counsel for the petitioners as well as the learned APP for the State.

At the outset, the learned counsel for the petitioners has submitted that petitioner no. 4, Jay Prakash Yadav @ Jay Prakash Singh has died and, as such, the application has become infructuous with respect to him. He, therefore, seeks permission to withdraw the application with respect to him.

Patna High Court CR. MISC. No.35869 of 2022(2) dt.13-07-2022 2/2 In view of the aforesaid submission, the application is dismissed as withdrawn with respect to petitioner no. 4, Jay Prakash Yadav @ Jay Prakash Singh.

So far as rest petitioners are concerned, the present application has been filed for modification of the order dated 26.06.2020, passed in Cr. Misc. No. 80475 of 2019, by which the petitioners were granted anticipatory bail. It is submitted that due to Covid-19 pandemic and communication gap, the petitioners could not surrender in the court below and furnish the bail bond within the stipulated time. For the reasons disclosed in this application, it is allowed and the time granted by order dated 26.06.2020, passed in Cr. Misc. No. 80475 of 2019 for surrender of the petitioners and furnishing bail bond is extended by four weeks from today.

Office shall ensure that all defects are removed by the petitioner within the stipulated time mentioned hereinabove, failing which, the matter shall be brought to the notice of this Court.
