In this case, the petitioner is seeking regular bail in connection with Mufassil P.S. Case No.19 of 2016, registered for the offence punishable under Sections 399, 402, 414 of the Indian Penal Code and under Section 25(1-B) A, 26/35 of the Arms Act. The police upon information that some criminals have assembled with motorcycles at G.T. road Rajpura and are making preparation to commit robbery raided the place, two persons have fled away and four persons have been apprehended with the stolen motorcycle, one of them was the petitioner. Learned counsel for the petitioner submits that from the possession of the petitioner only mobile phone was recovered,
Patna High Court Cr.Misc. No.18457 of 2016 (3) dt.10-05-2016 2/2 but the fact is that there were four persons and three motor cycles. In such view of the matter, this Court is not inclined to grant bail to the petitioner. However, liberty is given to the petitioner to renew the prayer of bail after completing nine months judicial custody.
