Petitioner is a mechanic and while he was punching new number over engine as per direction of a person who was present there, accordingly apprehended and he disclosed his identity as Kawal Kishore Yadav. On query, the aforesaid Kawal Kishore Yadav has disclosed that he has brought the aforesaid engine from a scrap shop located at Raxaul. He had also claimed other vehicles, Santro as well as Bolero, which were also brought by him for the aforesaid purpose.

It has been submitted on behalf of the petitioner that he has got no information with regard to nature of the engine brought

Patna High Court Cr.Misc. No.23450 of 2015 (2) dt.10-07-2015 2/2 up by the aforesaid Kawal Kishore Yadav. Being a mechanic he was following instruction of owner of the vehicle. Further submitted that the petitioner happens to be under custody since 15.03.2015 having no criminal antecedent.

Learned Additional P.P. opposed the prayer.

As such, the petitioner Chandeshwar Paswan is directed to be released on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Raxaul at Motihari, East Champaran, in connection with Ramgarhwa P.S. Case No. 23 of 2015.
