The petitioner seeks bail in a case under Section 302 and other sections of the Indian Penal Code.

The prayer for bail of the petitioner was earlier rejected vide order dated 17.12.2014 passed in Cr. Misc. No. 28453/ 2014. The petitioner has again renewed his prayer for bail. There is specific allegation against the petitioner that he assaulted the deceased.

A report was called for about the stage of trial. The learned Additional Sessions Judge has reported that the accused persons have filed a petition under section 227 of the Cr. P.C and the same is being pending for filing rejoinder. Considering the aforesaid facts, I am not inclined to enlarge the petitioner on bail. Accordingly, the same is rejected.

No.23437 of 2015 (4) dt.12-08-2015 2/2 The trial court is directed to expedite the trial and conclude the same holding the trial on day to day basis within six months from the date of receipt/ production of a copy of this order.
