The petitioner is languishing in custody since 12.05.2015 in connection with Town P.S. Case No. 128 of 2015 for the offences instituted under Section 379 of the IPC. It is alleged that the motorcycle of the informant was stolen away by co-accused Binod Singh.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 12.05.2015 and the charge sheet has been submitted in the present case. There is no allegation of tampering with the witnesses against the petitioner. He is not named in the F.I.R. Except for confessional statement of coaccused there is no other material to suggest his implication in the

Patna High Court Cr.Misc. No.22269 of 2016 (4) dt.02-08-2016 2/2 present case. There is no recovery of any incriminating article from conscious possession of the petitioner. He has not been put on T.I. Parade to ascertain his implication in the present case. On behalf of the State it has been submitted that the name of the petitioner has come in course of investigation. Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-III, Begusarai in connection with Town P.S.
