The petitioner is in custody in a case registered under Sections 302/34 of the Indian Penal Code.
It is alleged by the informant that on 7.3.2014 he was informed by a labour that firing has been done on his brick kiln (Chimni). He immediately rushed to the Chimni and found that office of Chimni was burnt and Chawkidar Surendra Singh, son of late Ram Briksh Rai was lying dead. He gave information to the Officer Incharge Phenhara Police Station, who case at the spot and after completion necessary procedure took the dead bodies for post mortem to Motihari. The motive of the occurrence has been stated to be Rangdari. It is further alleged that Chimni was started on 24.1.2014 and from the said date Rangdari was demanded on
Patna High Court Cr.Misc. No.23997 of 2015 (2) dt.06-07-2015 2/2 Mobile No. 9199559815 of his son from mobile no., 9507375504. The caller was stating that he is the man of Azad Hind Fauj and his name is S.K. Dubedi and he required heavy amount to run organization and threatened for dire consequences if the amount was not paid.
On behalf of the petitioner it has been submitted that the petitioner is not named in the FIR. The name of the petitioner has come on the confessional statement of co-accused. Further it has been submitted that the petitioner is in custody since 28.02.2015. Further, other co accused has been granted , vide Annexure 2 to the present application.
On behalf of the State, it has been submitted that the name of the petitioner has come in course of investigation. Considering the facts aforesaid, let above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Uma Shanker, Judicial Magistrate, 1st Class, Sikrahna at Motihari, district- East Champaran, in Phenhara P.S.Case No.12/2014 (Sudhir Singh, J) singh/- U
