JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 26-04-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections 461, 379, 295, 411, 414, 420 of the Indian Penal Code, 25 Antiques and Treasure Act and 30(1)(iii) Ancient Monument and Archeological Sites and Remains Act.

Petitioner is not named in the first information report but in course of investigation, the name of petitioner came in confessional statement of co-accused. Moreover, except the confessional statement of co-accused, there appears to be nothing against the petitioner. Petitioner does not have any criminal antecedent and is languishing in jail custody since 18.1.2016. Accordingly, the petitioner above named is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten
