The petitioner apprehends his arrest in connection with Tekari (Panchanpur O.P.) P.S. Case No. 05 of 2019 registered under Sections 419, 420 and 467 of the Indian Penal Code.

The accusation is of withdrawing of Rs.40,000/- from the account of the informant, Bhola Yadav, by using the ATM.

Learned counsel for the petitioner submits that petitioner is not named in the F.I.R. but in course of investigation, one Chandu was apprehended in another case, in which, his confessional statement was recorded, who also

No.33952 of 2019(2) dt.23-05-2019 2/2 disclosed the name of petitioner about withdrawing of money from the account of the informant except that nothing has been collected by the Investigating Officer against the petitioner. In fact, petitioner has been made accused in similar nature of case, i.e., Civil Linea P.S. Case No. 12 of 2019 due to that reason, police managed to implicated the petitioner in the present case. Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-VI, Gaya, in connection with Tekari (Panchanpur O.P.) P.S. Case No. 05 of 2019, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
