JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 06-05-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner was granted bail before the commitment of the case and the concerned court after submission of charge sheet issued summons, bailable warrants of arrest and other processes to ensure the presence of the petitioner for the purpose of commitment but petitioner did not appear resulting the commitment of the case in absence of the petitioner and, subsequently, it appears that the bail bonds of the petitioner was cancelled.
Submission on behalf of the petitioner is that petitioner was arrested in Katra P.S.Case No. 25 of 2009 on 23.02.2009 and he remained in jail custody till the year 2011 and was released
Patna High Court Cr.Misc. No.19972 of 2016 (2) dt.06-05-2016 2/2 from jail when he got acquitted in Katra P.S.case No. 25 of 2009. Moreover, petitioner is in jail custody since 13.03.3016 and he has not misused the privilege of bail intentionally. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of 9th Additional Sessions Judge, Muzaffarpur in connection with Session trial no. 23 of 2014 arising out of Katra P.S.Case No. 46 of 2006.
