JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 02-11-2021 At the outset, learned counsel for the petitioner seeks permission to add sections of Arms Act in para 1 of the petition. Permission is accorded and the same may be added during course of the day.

Heard both parties.

The petitioner seeks bail in Motipur P.S. Case No. 69 of 2021, registered for the offence punishable under Sections 413, 414, 399, 400, 402, 120(B) and 34 of the Indian Penal Code and sections 25(1-b)a, 26, 35 of the Arms Act. As per the prosecution case, one country made pistol with live cartridge has been recovered from possession of this petitioner. Two motorcycles were also seized by the police. It is submitted on behalf of the petitioner that nothing has been recovered from conscious possession of this petitioner.

Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate 14th, west Muzaffarpur in connection with Motipur P.S.
