1. Heard learned counsel for the petitioners, learned A.P.P. for the State and learned counsel appearing on behalf of the informant.

2. The petitioners seek bail in a case registered for the offences punishable under Sections 147, 148, 149, 323, 307, 354 and 379 of the Indian Penal Code as well as Section 27 of the Arms Act.

3. Learned counsel for the petitioners submits that the petitioners have antecedent of one case and are in custody since 13.03.2024.

4. The informant alleges that on 16.11.2023 her husband was going to harvest paddy at 07:00 p.m. when 25 named accused persons including the petitioners intercepted him and assaulted him brutally and Subelal Yadav fired causing

Patna High Court CR. MISC. No.39219 of 2024(5) dt.21-09-2024 2/2 injury on the back of the husband of the informant, thereafter the armed accused entered her house and assaulted Bhaswa Devi and Kumari Jyoti and also acted inappropriately with them.

5. Learned counsel for the petitioners submits that petitioners have been falsely implicated in the instant case by the informant. It is further submitted that allegation of assault is general and omnibus in nature and specific allegation of firing at the husband of the informant is against Subelal Yadav.

6. Learned A.P.P. for the State and learned counsel appearing on behalf of the informant opposed the prayer for regular bail of the petitioners.

7. Considering the submissions made by the learned counsel for the petitioners, the petitioners, above named, are directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending in connection with Sheikhpura P.S. Case No. 808 of 2023.
