JUSTICE DINESH KUMAR SINGH ORAL ORDER 13-07-2015 Heard learned counsels for the petitioner and the State. This an application for grant of bail to the petitioner in a case of misuse of bail.

Initially the case was registered for the offences punishable under Sections 47(a) of the Excise Act and the petitioner was granted bail. The bail bonds were cancelled on 7.5.1999 and right now the petitioner is languishing in custody since 6.4.2015.

It is submitted that the petitioner will regularly appear before the court below. The impugned order does not reflect any progress since the petitioner is in custody.

Considering the aforesaid facts, let the above named petitioner be released on bail on furnishing bail bond of Rs.

Patna High Court Cr.Misc. No.23967 of 2015 (2) dt.13-07-2015 2/2 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned ADJ-III, Bhojpur at Ara in connection with NDPS Case No. 15 of 1995.

The learned court below will be at liberty to cancel the bail bonds of the petitioner in case he defaults on three consecutive occasions.
