JUSTICE DINESH KUMAR SINGH ORAL ORDER 29-06-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Section 396 of the Indian Penal Code and Section 27 of the Arms Act.

One Ram Niwas Mishra was robbed and killed by three miscreants leading to the registration of the present case against six unknown persons. During investigation, one Arun Kumar was apprehended who suggested that he procured the country made katta and cartridges from the room of the petitioner. It is submitted by learned counsel for the petitioner that except confession of co-accused, there is nothing on record to suggest the complicity of the petitioner. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent.

Let the learned court below consider the prayer for regular bail of the petitioners if they surrender within a period of six weeks in connection with Sugauli P.S. Case No. 466 of 2014 pending in the court of learned CJM, East Champaran, Motihari. Accordingly, the application is disposed of.
