JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 07-04-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Although petitioner is named in the first information report but allegation against him is that he along with co-accused Prem Paswan and Arjun Paswan caught hold of the injured, whereas co-accused Santosh Sah gave dagger blow on his back and, furthermore, it is stated that petitioner and other co-accused assaulted the injured Vikram Paswan.

The contention on behalf of the petitioner is that coaccused Prem Paswan, having more or less similar allegation, has already been granted privilege of bail by a co-ordinate Bench of this Court, whereas petitioner is in jail custody since 05.01.2016.
