The petitioner has preferred this application for grant of regular bail in a case registered under section 392 of the Indian Penal Code.

As per the prosecution case, three accused persons on a motorcycle robbed the informant of his belongings on the point of knife.

It is submitted by learned counsel for the petitioner that the F.I.R. was registered against three unknown. Referring to the order of the learned Court below it is submitted that the name of the petitioner transpired in course of confessional statement of Vikash Kumar Kushwaha recorded in another case

Patna High Court CR. MISC. No.45004 of 2021(2) dt.28-01-2022 2/2 as also on the statement of spy. No incriminating article has been recovered from the possession of the petitioner and inspite of being in custody since 3.6.2021 and chargesheet having been submitted in the case, the petitioner has not been put on T.I. parade. With respect to the Sidhwalia P.S. Case no.26 of 2021, which finds mention in the order of the learned trial Court it is submitted that the petitioner has been enlarged on bail in the said case vide order dated 27.1.2022 passed in Cr. Misc. no.51938 of 2021.

Having heard learned counsel for the parties and taking into consideration the submissions made on behalf of the petitioner together with the chargesheet having been submitted in the case, the Court directs the petitioner to be enlarged on bail in connection with Sidhwaliya P.S. Case no. 14 of 2021 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Gopalganj.
