JUSTICE DINESH KUMAR SINGH ORAL ORDER 24-07-2015 Petitioner is languishing in custody since 05.01.2015 in a case registered for the offences punishable under Section 364 of the Indian Penal Code.

The accusation is kidnapping the wife of the informant. In 164 Cr.P.C statement the victim has stated that she was being kidnapped by this petitioner and kept for two months and her ornaments were taken. It is further alleged that petitioner used to assault her and ravished her. It is submitted by learned counsel for the petitioner that victim under some apprehension gave statement under Section 164 of the Cr.P.C and she has retracted from the statement given under Section 164 Cr.P.C by filing the same through affidavit before learned Court below that under the apprehension of husband she made her 164 Cr.P.C statement as she was never kidnapped.

Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sheohar in connection with Piprahi P.S. Case No. 132 of 2013.
