JUSTICE VINOD KUMAR SINHA ORAL ORDER 29-07-2019 Petitioner seeks bail in anticipation of his arrest in connection with Ganga Bridge P.S. Case No. 28 of 2019 registered for the offence punishable under Section 30(a) of Bihar Prohibition and Excise Act.

Allegation as per FIR is of recovery of huge quantity of liquor and one person was arrested, who disclosed the name of the petitioner and other accused persons as partners in liquor business.

Submission of learned counsel for the petitioner is that nothing has been recovered from his possession and he has falsely been implicated only on the basis of confessional statement and though he is accused in other cases but not in similar type.

Heard learned APP also, who has opposed the prayer

Patna High Court CR. MISC. No.32418 of 2019(3) dt.29-07-2019 2/2 for anticipatory bail but could not point out any other material in the case diary except the confessional statement of co-accused. In view of above facts and circumstances, let petitioner, in the event of arrest or surrender, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-II-cum-Special Judge, Vaishali at Hajipur, in connection with Ganga Bridge P.S. Case No. 28 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned.
