The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 272, 273 of the Indian Penal Code and 47a of the excise Act. Prosecution case is that on secret informant that illegal wine is being sold, the raid was laid on the shop of the petitioner when search was made 20 bottles Thuder Bold beer, each containing 650 ml, 50 pieces of plastic bottles of country made liquor, each containing 200 ml,, total 10 litres, were recovered.

It is submitted by learned counsel for the petitioner that maliciously the present case has been lodged and the petitioner is accused in one other case being Harsidhi P.S. Case

Patna High Court Cr.Misc. No.16596 of 2016 (2) dt.18-04-2016 2/2 No.359/2015 wherein he has been granted bail. Considering the nature of recovery, it is a case for consideration of prayer for regular bail.

Let the learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with Harsidhi P.S. Case No.287/2015, pending before the learned CJM, Motihari, East Champaran.

With the above observation, this application is, accordingly, disposed off.
