JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 20-05-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offence punishable under Section 30(a) of Bihar Prohibition and Excise Act, 2016.

The alleged recovery is said to have been made from a Panchayat Bhawan. Neither petitioner was caught on the spot nor anything was recovered from his conscious possession. No doubt, petitioner does have criminal antecedent of two cases of similar nature but in the present case, the name of petitioner was disclosed by sources of police.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above

Patna High Court CR. MISC. No.32927 of 2019(2) dt.20-05-2019 2/2 named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge -Vcum Special Judge, Excise Act, Darbhanga in connection with G.O. Case No. 1066 of 2018 arising out of Bahadurpur P.S. Case No. 518 of 2018.
